Terms OF Service

 Estimates, Quotes, and Scope of Work

  • Estimates vs. Firm Quotes: Initial pricing provided over the phone, via our AI estimator, or verbally without a thorough on-site inspection are rough estimates only. Final, firm quotes are provided only after an on-site evaluation by our technician.

  • Unforeseen Conditions: If unforeseen conditions (e.g., hidden pipe damage, code violations, structural impediments, hazardous materials) are discovered during the performance of work, the Company reserves the right to halt work and provide a revised quote. The Customer is responsible for the cost of work performed up to that point.

  • Permits and Code Upgrades: Unless explicitly stated in the written quote, the cost of municipal permits and required code upgrades are not included and will be billed additionally.

Exclusions and Limitations of Liability

The plumbing industry involves working with pressurized systems, aged infrastructure, and concealed elements. To protect both parties, the following limitations apply:

  • Pre-Existing Conditions: We are not liable for damage caused by the failure of pre-existing pipes, valves, fixtures, or systems that degrade, break, or leak during the normal course of our service due to age, corrosion, or prior improper installation.

  • Drain Clearing and Root Intrusion: We do not guarantee that snaking or hydro jetting will permanently clear lines compromised by root intrusion, collapsed sections, or severe belly/sag issues. If a cable or equipment becomes lodged in a defective line, the Customer is responsible for the cost of extraction, which may require excavation.

  • Restoration Work: Unless specifically contracted, our services do not include the repair or restoration of drywall, plaster, tile, cabinetry, flooring, concrete, asphalt, or landscaping disturbed during the course of plumbing repairs or excavation.

  • Water Damage and Mold: We are not responsible for existing water damage, mold, mildew, or the remediation thereof. We are also not liable for secondary damages resulting from a plumbing failure before our arrival or during the diagnostic process.

  • Maximum Liability: Under no circumstances shall the Company's liability exceed the total amount paid by the Customer for the specific service call giving rise to the claim. We are not liable for incidental, consequential, or punitive damages, including lost revenue or loss of use.

Warranties

  • Labor Warranty: We provide a standard 30-day warranty on our labor for repairs, and a 1-year warranty on labor for new installations, unless otherwise specified in writing. Drain clearing services for stoppages carry no warranty unless accompanied by a camera inspection verifying the line is structurally sound.

  • Parts and Equipment: Parts, fixtures, and equipment supplied by the Company are covered solely by the respective manufacturer's warranty. The Company does not independently warranty manufactured goods.

  • Customer-Supplied Parts: If the Customer supplies their own parts or fixtures, the Company provides ZERO warranty on the labor or the parts. If the customer-supplied part fails or leaks, subsequent visits to repair or replace it will be billed at standard rates.

  • Voiding of Warranty: Warranties are immediately void if the repaired or installed system is tampered with, altered, or serviced by anyone other than an Extra Care Plumbing technician, or if the system is subjected to misuse, abuse, or foreign objects.

 Payment Terms and Default

  • Due Upon Receipt: Payment in full is due immediately upon completion of the service unless prior commercial net-terms have been established in writing.

  • Deposits: Projects exceeding $1,000 or requiring special-order equipment may require a non-refundable deposit of up to 50% before work commences or materials are ordered.

  • Late Fees: Unpaid balances past 15 days will accrue interest at a rate of 1.5% per month (18% annually) or the maximum rate permitted by Memphis law, whichever is less.

  • Collection Costs: If an account is sent to collections or requires legal action, the Customer agrees to pay all collection costs, reasonable attorney's fees, and court costs incurred by the Company.

  • Mechanic's Liens: The Company reserves the right to file a mechanic's lien against the serviced property for unpaid balances, in accordance with Memphis state law.

Right to Refuse Service

  • We reserve the right to refuse service, terminate a contract, or leave a job site if our technicians encounter unsafe working conditions, hazardous materials (e.g., asbestos, raw sewage without proper abatement), hostile or abusive behavior from the Customer, or if the requested repair violates local building codes.

Governing Law

  • These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Memphis, without regard to its conflict of law principles. Any legal action shall be filed exclusively in the courts.
